The International Trade Commission (ITC) today made an affirmative determination in the preliminary phase of its Creatine Monohydrate antidumping investigation.

The ITC found a reasonable indication that Phanstiehl Laboratories is materially injured by imports of creatine from the People's Republic of China. The ITC 's investigation arises out of the February 12, 1999 filing of an antidumping petition by Pfanstiehl Laboratories, Inc. and comes on the heels of a similar investigation instituted earlier by the US International Trade Commission. Pfanstiehl Laboratories has substantial evidence that Chinese manufacturers are importing creatine into the United States in ever-increasing volumes at prices that are significantly below their cost of production.

Based on this unanimous affirmative determination, the US Department of Commerce will continue to conduct its antidumping investigations with final judgement due on or about July 22, 1999. Pfanstiehl has requested in its petition that the dumping penalty should range from 120 percent to 153 percent, possibly retroactive.

Interesting to note, the lower quality and bitter off-taste of the Chinese creatine was presented as part of the defense at the February 12th hearing in an attempt to justify the below cost imported Chinese creatine.

This is the first petition filed for a nutritional supplement. Anti-dumping petitions have been filed by US companies that manufacture computer chips, chemicals, supercomputers, motorcycles, orange juice, TV picture tubes and steel.
